Green was left with head injuries and a permanent scar on his face when the SABC car, driven by cameraman Etienne de Beer, hit a stationary fire truck in thick smoke on a road near Gansbaai.
Judge Siraj Desai said the driver of the fire truck, Willem Damon, had given contradictory versions to the court about the incident.
It was clear he had failed to take reasonable steps to warn oncoming traffic about the parked truck in the poor visibility.
The fund was liable for such damages as Green could prove in a separate hearing.
Desai said that because he had found the fireman, the “insured driver”, negligent, it was not necessary to make a ruling on De Beer’s role in the accident.
Green is claiming R700 000 from the fund. – Sapa
