Accused Nkululeko Theophilus Ngcana (50) appeared before the Phuthaditjaba Magistrate court on Monday, 15 February 2021 facing charges of corruption and defeating the administration of justice.
It is alleged that in September 2017, Ngcana persuaded a suspect who was facing charges of operating a motor vehicle with a fraudulent license disc to pay R600 in order for him to withdraw charges against the suspect. The suspect agreed to pay R600 as persuaded by Ngcana. Later the suspect realised that Ngcana did not withdraw the charges against him as agreed. He then reported the matter to the Senior NPA prosecutor.
In January 2020, another accused who is a police officer gave Ngcana R500 to pay on his behalf for admission of guilt on a charge of reckless or negligent driving. Ngcana took R500 as agreed by the accused to pay on his behalf but he did not pay to the court as agreed. The accused received summonses to appear in court for failure to pay R500 for admission of guilt. Upon inquiry at court, he found out that Ngcana did not pay R500. He then reported the matter to the Senior NPA Prosecutor.
The matter was then reported to the Hawks’ Serious Corruption Investigation for a further probe which led to the arrest of Ngcana on Sunday, 14 February 2021.
The case against Ngcana has been postponed to Monday, 10 March 2021 for further investigation. Ngcana was released on R1500 bail.
